Hague Convention on the Civil Aspects of International Child Abduction
The Hague Convention on the Civil Aspects of International Child Abduction is a multilateral treaty ratified by approximately 100 countries, including Brazil, that primarily addresses wrongful child abduction within international family law by establishing mechanisms for the prompt return of unlawfully removed or retained children to their country of habitual residence, thereby protecting them from abduction harms and ensuring the left-behind parent maintains access and contact.
Parents across borders can seek swift judicial intervention to resolve such disputes and determine the proper jurisdiction for the child's placement. Importantly, the Convention does not regulate immigration issues for parents or children, nor does it serve as a custody determination; rather, its core purpose is to identify which country's courts should handle any ensuing custody litigation.
